Welcome to Today Star Marketing Agency. By accessing our website or engaging our services (Photography, Videography, SEO, Digital Marketing, Graphic Design, and Web Development), you agree to comply with and be bound by the following terms.
1. Scope of Services
Today Star Marketing Agency agrees to provide the services outlined in the specific project proposal or invoice. Any additional work requested outside the original scope will be subject to a new estimate and agreement.
2. Client Responsibilities
To ensure project timelines are met, the client agrees to:
- Provide all necessary branding assets, text, and media in a timely manner.
- Provide clear feedback during designated revision periods.
- Secure necessary permissions for any third-party materials provided to us.
3. Payment Terms
- Deposits: A non-refundable deposit may be required before work begins on any project.
- Milestones: For long-term projects like Web Development or SEO, payments may be scheduled based on project milestones.
- Late Payments: We reserve the right to suspend services or withhold final files if payments are not made according to the agreed schedule.
4. Intellectual Property & Ownership
- Creative Works: Upon final payment, ownership of final graphic designs and edited media is transferred to the client. Today Star Marketing Agency retains the right to use project samples in our professional portfolio.
- Web Development: Code and backend structures remain the property of the agency until full payment is received.
- Raw Files: Unless explicitly stated in the project contract, raw photography or videography footage is not included in the final delivery.
5. Revisions and Approval
Each project includes a set number of revision rounds as specified in your proposal. Additional revisions requested after final approval or beyond the included rounds will be billed at our standard hourly rate.
6. SEO and Marketing Performance
While we use industry-standard practices to improve rankings and engagement, Today Star Marketing Agency does not guarantee specific search engine positions or a specific ROI, as these are subject to external algorithm changes and market competition.
7. Limitation of Liability
Today Star Marketing Agency shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our services, including but not limited to loss of profits, data loss, or service interruptions.
8. Project Termination
Either party may terminate a project with written notice. In the event of termination, the client is responsible for payment for all work completed up to the date of cancellation.
9. Governing Law
These terms are governed by and construed in accordance with the laws of the jurisdiction in which Today Star Marketing Agency operates.
